These terms and conditions (the “Terms and Conditions”)—last Updated January 15, 2025—govern the use of canadianartmap.com (the “Site”). This Site is a directory and marketing website and blog. The Site is owned and operated by Dale Barrett, who is based in Toronto, in the Province of Ontario, Canada. By using this Site, you indicate you have read and understand these Terms and Conditions and agree to abide by them at all times.

Users

Content Creators
Content Creators are Users who submit content to the site, such as images, text, logos, ads, and documents, and retain intellectual property rights to their submissions. They control how their content is used, displayed, and distributed.

Content Consumers
Content Consumers are Users who view, interact with, and utilize the content submitted by Content Creators.Content Consumers do not retain intellectual property rights to the content but can access and use it according to the site’s terms and conditions.

Users: Use and Rights

Content Creators’ Use and Intellectual Property Rights
All content published and made available on this Site is the property of each original content creator and/or the Site’s creator, depending on the specific content. Here’s a breakdown:

  • User-Generated Content 
    Users (businesses, individuals, etc.) who submit or authorize this Site to use their content, such as images, text, logos, or documents, retain the Intellectual Property rights to that content. This Site uses, displays, and distributes user-generated content at the discretion of the User who submits or allows the Site to use it.
  • Third-Party Content 
    If the site includes content created by third parties (e.g., stock images, data from other sources), the Intellectual Property rights remain with the original creators or licensors of that content.
  • Site Design and Structure
    The overall design, layout, and structure of this Site is the intellectual property of the site’s creator and owner. This includes the arrangement of listings, user interface design, and proprietary software or algorithms used to operate the site.
  • Original Content by Site Owners 
    Any content created specifically for the site by its owner or their employees, such as custom graphics, original text, and unique databases, is the intellectual property of the site’s creator.
Content Consumers’ Use
  • Content Consumer Access
    Content Consumer users may access and interact with the content available on the site.
  • Content Consumer Rights 
    Content Consumer users have no Intellectual Property Rights. They do not have ownership rights over the content they view or use.
  • Content Consumer Usage
    Content Consumer users must adhere to the usage policies and restrictions set by the Site and Content Creators.
  • Content Consumer Respect
    Content Consumer users must respect the intellectual property rights of Content Creators and follow the site’s terms of use.
Free Listings and Fees for Services

canadianartmap.com aims to be a comprehensive guide that identifies and locates art venues, art activities and art events across Canada; helps users navigate to, from and between them; is a vehicle for marketing and promoting art venues, activities and events; and an online platform that amplifies a diversity of artists’ voices and art works via descriptive listings of Canadian art venues and activities.

  • A BASIC Listing is complimentary at the discretion of the Publisher. What constitutes a basic listing may change from time to time at the discretion of the Publisher.
  • A PREMIUM Listing—with additional features, information and images—is offered at fixed rates. What constitutes a Premium Listing may change from time to time at the discretion of the Publisher.
  • Display and pop-up ads are available at fixed rates.
  • Rates for Listings and Ads—including related benefits—can be found on the “Listing & Ad Rates” page.
Accounts

Content Creators will be invited to create an account on the Site to submit and manage their content. Content Creators who create an account on the Site, agree to the following:

  1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account.
  2. All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.

canadianartmap.com and/or the Publisher reserves the right to suspend or terminate your account at any time if “you”—your organization and/or anyone representing your organization— use the site illegally, violate our “Terms and Conditions”, or are deemed by the Publisher to be in violation of, acting contrary to, or at odds with the site’s mandate.

Audio Content & Upload Terms
User Responsibility for Uploaded Audio

Users, venues, organizations, and contributors (“Uploaders”) are entirely responsible for any audio, text, music, voice recordings, or sound files (“Audio Content”) they upload or submit to CanadianArtMap.

UPLOADERS MUST ENSURE that they:

  • Own the copyright to the Audio Content
  • Have written permission or a valid license to use the Audio Content
  • Do not violate copyright, trademarks, moral rights, or privacy rights
  • Do not upload copyrighted music or audio without permission

License Granted to CanadianArtMap

By uploading audio, Uploaders grant CanadianArtMap:

  • A non-exclusive, worldwide, royalty-free license
  • To host, store, reproduce, distribute, stream, and publicly play the audio
  • Within listing pages, itineraries, map markers, and downloadable PDFs
  • For all current and future features of the platform

This license remains valid until the content is removed by the Uploader.


Prohibited Audio Content

Uploaders may not upload:

  • Music they do not own or have permission to use

  • Commercially released songs without licensing

  • AI-generated voices imitating real individuals

  • Audio containing confidential information, hate, harassment, or illegal material


Takedown and Removal

CanadianArtMap may remove or disable any audio at its discretion, including but not limited to:

  • Copyright complaints
  • Inaccurate content
  • Low-quality or inappropriate audio
  • Violations of these Terms

Indemnification

Uploaders agree to indemnify and hold harmless CanadianArtMap, its owners, and partners from any claims, damages, or legal fees arising from:

  • Copyright violations

  • Unauthorized use of music

  • Misrepresentation of rights

  • Any uploaded audio content


No Liability

CanadianArtMap is not responsible for:

  • Audio uploaded without proper rights

  • User misuse of uploaded audio

  • Claims from third parties

  • Loss or deletion of audio files

Third Party Goods and Services

canadianartmap.com may offer goods and services from third parties. We cannot guarantee the quality or accuracy of goods and services made available by third parties on our Site.

Links to Other Websites

Our Site contains links to third party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third-party website or service linked to on our Site. It is your responsibility to read the terms and conditions and privacy policies of these third-party websites before using these sites.

Limitation of Liability

canadianartmap.com and its directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity

Except where prohibited by law, by using this Site you—Content Creators and Content Consumers—indemnify and hold harmless the owner, directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law

These Terms and Conditions are governed by the laws of the Province of Ontario.

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify registered users by email of changes to these Terms and Conditions or post a notice on our Site.

Markers & Other Features

Tapping a marker opens an info box with that listing’s contact details, a description, and a “View Listing” button.

The “View Listing” button links to a full-page post with more listing details, images, and links.

Listings link to Google Directions for navigation. Use the location field to identify your location for directions to a venue or site, or between sites.

Filter Listings: Use the dropdown menu (hamburger ☰ on mobile) to filter by category, location, tag (e.g., “sculpture”), or venue name.

Toggle Full-Screen Button: Use this button for a full-screen view of the map on a desktop.

Current Location: Tap/click the target icon to focus the map on your location.
